From this Monday Uber and Cabify can work in Mendoza. The government regulated the mobility law Enables private transport via digital platforms. The tariff is not regulated, but drivers can only take passengers who are approached via mobile applications they are not allowed to lift customers on the street. The digital companies are "jointly and severally liable" with the providers of the service and have to pay local taxes and have a commercial office in Mendoza.
The special feature in the province of wine is that they simply catch and train the drivers of both applications and that there are still no Uber or Cabify cars in the streets. "We are ready to work in the coming days"Cabify informed the press.
The mobility law was sanctioned in July by Mendoza's legislature. The government of the radical Alfredo Cornejo was committed to regulate, establish and comply with the working conditions in September. The guild of taxi drivers (Aprotam) opposes the arrival of these electronic applications and has appealed to the courts to request the unconstitutionality of the law. In case this request does not come to fruition, you must insist that vehicles with a top platform are ordered based on the number of taxis to prevent the market becoming saturated.
For now, says the regulations published in the state magazine of Mendoza:
-The companies of digital platforms for private transport must register with the provincial Ministry of Transport. And they must have a home in Mendoza, a legal representative and tax the provincial collection agencies.
– All car owners who intend to offer the private transport service must apply for registration with the Transport Networks Companies (ERT), which the payment of the registration fee and associated audit, the regulatory documentation of the vehicle that is meant to provide the service, the documentation that proves the identity of the managementr and the National driver's license for professionals, registration in AFIP and ATM (provincial taxes) and insurance of the automobile to transport passengers.
–The costs that are charged are free of charge. "The price the passenger will pay for the contracted trip is determined by the transport network company and offers the electronic platform the possibility of estimated calculation based on the points of origin and destination", the standard says. And completely: "The application must enable the user to execute the electronic payment and, if the passenger so requests, for an exceptional situation, payment in cash as soon as the transfer is completed".
There will be a basic rate and a dynamic rate, depending on the demand. The cars of digital platforms have a tax of 1% more gross revenue than what the taxis pay.
– They will not be able to lift temporary passengers, outside the application. "In no case shall the vehicles authorized to provide these services be able to make a public offer, or convey passengers who do not prove their quality as users of the electronic platform and the earlier request for the journey, "says the regulatory decree.
– The authorized vehicles must undergo periodic technical inspections of the device and must at all times maintain the hygiene of the vehicle. There are no requirements on the type of vehicle, comfort or seniority.
– The companies are "jointly responsible for the service" and the "obligations" imposed on operators and drivers, "according to the regulations.
