Kota Kinabalu: A 27-year-old man was ordered to enter his defense on Tuesday to accuse him of raping his progeny.
Sessions Judge Ainul Shahrin Mohamad ruled that the court was convinced that the Prosecution had instituted a prima facie case against him.
She introduced Sept. 24 for the defense of the man.
The man is accused of committing the offense against the 13-year-old girl at 3:00 pm at the beginning of September 2017 in a house in a village in Kudat.
He had filed the complaint on 22 November 2017 under Article 376 (3) of the Criminal Code, which provides for a prison sentence of between eight years and 30 years, and imprisonment, for sentencing.
Deputy Prosecutor Rustam Sanip sued while the man was represented by Amli Nohin.
Meanwhile, a 29-year-old man in the Magistrate's Court claimed a lawsuit against having a handphone that was believed to have been stolen. Mohd Razuan Suhaibun is accused of having the gadget that he has not reasonably explained how he got him to the Papar hospital at 5:30 pm on 5 July.
Magistrate Cindy Mc Juce Balitus, however, postponed the case until 27 August for the complainant, who informed the court that he wished to withdraw the case, to submit his police report.
The complainant, Teo Boon Loon, who was present in the courtroom, told the court that Razuan was not the one who broke into his house and that he believed that Razuan, who bought the handset via the online website with classified ads, did not know it was stolen. Teo also said that he felt sorry for Razuan, who only works cleaner in the hospital.
Razuan was released on bail of RM1,000 in two deposits. The indictment referred to in Article 22A (1) of the Minor Offences Ordinance provides for a fine of up to RM100 or 14 days in prison or both at conviction.
