PETALING JAYA: Rosemary Ginam, 38, who was held in police custody for 42 days without trial, has been released on bail.
Her lawyer Sachpreetraj Singh Sohanpal said that Rosemary was reunited with her family on Tuesday (August 28), despite being in pre-trial detention until Wednesday (August 29).
"She is outside, her family members are very excited and relieved," he said when he contacted.
Rosemary was handcuffed in her Kajang house for her children by police officers on 17 July.
She was arrested in connection with a cheating case involving a travel company that would have duped consumers by inducing them to buy fake packages at a cheap price.
The family believes that Rosemary, who worked at the company, is a scapegoat.
Her husband, Hasan Jambai, 40, a spare parts vendor, had to take the job off to take care of their three children aged 17, 14 and 9 years.
Since her arrest, Rosemary has been transferred to police stations throughout the country without being charged and without end.
So far, Rosemary has been taken to police stations in Kuala Lumpur, Perak, Penang, Melaka, Terengganu and Negri Sembilan.
Hasan submitted a report to the Human Rights Commission of Malaysia (Suhakam) on the detention of his wife on Monday (27 August).
Keeping someone in custody for 42 days without trial is exaggerated and an abuse of power by the police, says human rights group Fortify Rights, legal director Eric Paulsen.
"She is not a flight hazard as she is a Malaysian, married, and mother of three, and the police can easily ask her to come along to cooperate if necessary.
"A good example is our former Prime Minister Datuk Seri Najib Tun Razak, who is also under criminal investigation, but may come to help investigations instead of being held indefinitely," he said when he contacted.
He urged the police to exercise common sense and discretion when investigating cases.
"The magistrate, who delivers the pre-trial detention, should also play a role and not just rubber everything without knowing the full context," he said.
